This is fourth application for grant of bail. Earlier, this Court had rejected the bail application on merits. Liberty was however reserved to revive, if trial is not concluded within four months. A report from the Court below has been sought and was also called. The report shows that the trial is not concluded because of delay in appearance of witness.

True it is that there is a delay in trial, looking to the gravity of offence, I am not inclined to grant bail to the applicant only on the ground that he has remained in jail since 30-07-2016.

Accordingly, the bail application is rejected. The trial Court shall continue with the trial on day to day basis without granting unnecessary adjournment, once the witness appears. If the witnesses do not appear, the trial Court may also take coercive steps for appearance of witnesses. Warrant for appearance of witnesses shall be promptly executed by the concerned police officials. A fresh report shall be submitted before this Court after two months through the Registry.
