The transfer order is under challenge on the ground that the petitioner is presently under suspension vide order dated 22.07.2016 passed by the Collector.

It appears that while undergoing suspension, the transfer order has been issued by the State Government, in all probability without having any information in this regard, placed before the State while issuing a transfer order of the petitioner. An employee who is under suspension, cannot be subjected to transfer.

The State Government is directed to consider this aspect and pass

appropriate orders in the matter. The impugned order in respect of the petitioner shall not be given effect to.

The petition is accordingly disposed off.
