Hon'ble Shri Justice P. Sam Koshy Order on Board 20.05.2020

1. The limited grievance that the petitioner has raised for in the present writ petition is in respect to the operation of a Bus bearing Registration No. CG10G-0173 on the route between Manendragarh to Chrimiri via Ledri, Koda, Devadand, Khadgawan, Dubchhola, Sonamani.

2. According to the counsel for the petitioner, the aforementioned bus operated by the Respondent No. 3 was granted Temporary Permit for a period between 03.02.2012 to 02.02.2017 and thereafter there has

-2been no renewal of permit of the said bus. In spite of that, the respondent no. 3 till date is continuously operating the said bus illegally.

3. If the said averment of the petitioner is to be believed then the act on the part of the Respondent No. 3 is certainly something very serious. It also shows lapse on the part of the Respondent No. 2 in not taking appropriate steps in checking the buses, which are plying whether they have got proper permit or not.

4. Considering the seriousness of the nature of complaint that the petitioner has raised, this Court is of the opinion that the ends of justice would meet, if the Respondent No. 1 and 2 are directed to take immediate steps in this regard and also verify the fact and take steps promptly. It is further directed that in case if there is any lapse on the part of the Government officers, who have permitted the Respondent No. 3 to operate the bus, it is expected that the Respondent No. 1 shall take appropriate disciplinary action in this regard.

5. The present writ petition, accordingly stands disposed off. Sd/- (P. Sam Koshy) Judge Rahul
