Hon'ble Shri Justice Gautam Chourdiya Order on Board 06/04/2021

1. The applicant has preferred this bail application under Section 439 of Cr.P.C. as he has been arrested in connection with Crime No.03/2021 registered at Police Station- AJAK, P.S. Ambikapur, District Surguja, C.G. for the offence punishable under Sections 376(2)(n) of Indian Penal Code and Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

2. The matter is listed for order on default as the counsel for the applicant has filed MCRC under Section 439 of CRPC instead of Criminal Appeal under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

3. In view of above, learned counsel for the applicant seeks to withdraw the same with liberty to file a duly constituted appeal. However, she prays for return of certified copy of the impugned order.

4. Permission granted.

5. Accordingly, the bail application stands dismissed as withdrawn with the aforesaid liberty.

6. Registry is directed to return the certified copy of the impugned order to the counsel for the applicant on his furnishing true authenticated Xerox of the same.
