Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 18/12/2015 Heard.

1. The petitioner has approached this Court being aggrieved by his non-selection.

2. Learned counsel for the petitioner submits that the petitioner was the great-grandson of freedom fighter namely Late Badar @ Bandu. He submits that he is the linear descendant of the freedom fighter. There is no reason why he should be deprived of the benefit of selection by treating him as one entitled to reservation under freedom fighter category. It is submitted that the petitioner only represented his cause before the respondent authority.

3. Learned counsel for respondent No.3 submits that the petitioner has not placed on record any document to show that the great-grand-son of a freedom fighter is also entitled to benefit of reservation category seats.

4. After considering the submissions made learned counsel by the parties, I am inclined to dispose off the matter with liberty to the petitioner to represent before respondent No.2, who shall consider and decide petitioner's representation against rejection of his candidature, by speaking order, within a period of 4 weeks from the date of submission of representation before it.
