1. The challenge made in this writ petition is to the rejection slip (Annexure P1) whereby the petitioner was informed that her candidature for the post of Constable (GD) in Central Forces has been rejected on the ground of variation of her father's name.
2. Learned counsel for the petitioner submits that in application form, due to inadvertence, the father's name of petitioner has been shown as Domesh Kumar whereas she is daughter of Ramesh . He submits that the mistake has occurred because of the fact that in the mark sheet of Chhattisgarh State Open School, Raipur, the father/husband name was mentioned wherein Domesh Kumar was written. As such while filling up the application Form in Column No.2 instead of Ramesh , her husband's name Domesh
Kumar has wrongly been written which led to disqualification of her candidature.
3. Perused the documents. A perusal of the documents would show that the petitioner is wife of Domesh Kumar and in the High School Certificate, it is mentioned as father/ husband name. The affidavit is placed on record vide Annexure P-5 wherein it has been stated that she is wife of Domesh Kumar and daughter of Ramesh. Considering the mistake which appears to be hyper technical, the candidature of petitioner cannot be subjected to disqualification.
4. Taking into the aforesaid factual position, the rejection slip Annexure P-1) whereby the candidature of the petitioner for the post of Constable (GD) has been rejected is set aside. The father's name of the candidate Savita Bai be treated as Ramesh considering the Affidavit (Annexure P-5). The candidature of the petitioner shall be considered for further selection process.
