Heard Learned Counsel appearing for the parties on the present application (M.C.C.) under Order 44 Rule 1 read with Section 151 of the Code of Civil Procedure. Also perused the material available with due care.

On due consideration, the M.C.C. is allowed. The Applicant is permitted to file and prosecute the first appeal annexed with the M.C.C. as an indigent person.
