Ali, Advocate Hon'ble Shri Justice Pritinker Diwaker Order On Board 28/08/2015 Against assessment order dated 30th March, 2015, the petitioner has already preferred appeal before the CIT (Appeals)/respondent No.2 on 1.5.2015 and as informed, the said appeal is pending consideration.

2. Counsel for the petitioner submits that instead of entertaining this petition, direction may be issued for early disposal of the pending appeal. He, however, submits that till decision of the appeal, the respondents may be directed not to withdraw the amount from petitioner's account bearing No.3246009400012184 & 3246002100011426 maintained in Punjab National Bank, Raipur.

3. Counsel appearing for respondents No. 2 & 3 has no objection to the proposition as put forth by the petitioner.

4. Considering the facts and circumstances of the case, the petitioner is permitted to withdraw this petition. Respondent No.2 is directed to decide the pending appeal of the petitioner within four weeks from the date of production of copy of this order.

5. As the respondents have no objection, status quo with regard to aforesaid bank account of the petitioner shall be maintained by the parties till decision of pending appeal of the petitioner.
