(2) At the outset, learned counsel for the petitioner would submit that the petitioner may be permitted to withdraw this petition with liberty to prefer an appeal under Section 23 of the Chhattisgarh Civil Services (Classification, Control & Appeal) Rules, 1966, however, he would submit that the appellate authority may be directed to decide the

appeal at the earliest.

(3) The writ petition is permitted to be withdrawn with the liberty as prayed for. If the appeal is preferred within 30 days from today by the petitioner, the appellate authority shall consider and decide the appeal by a speaking order, at the earliest, preferably within a period of 3 months from the date of its presentation.
