For the reasons mentioned in the application and as per the law laid down by the Hon'ble Supreme Court in the matter of State of Haryana Vs. Chandra Mani & Ors. reported in (1996) 3 SCC 132, the delay of 50 days in filing the petition is hereby condoned. Also heard on application for grant of leave to appeal filed under Section 378(3) CrPC, 1973.

Looking to the statements of the complainant supported with medical evidence, grounds for appeal are debtatable, therefore, leave to appeal is granted.

Let this CrMP be registered as Acquittal Appeal. The appeal is admitted.
