1. The petitioner has filed this writ petition challenging the order dated 2.2.1998 by which one increment has been withheld with non-cumulative effect and also withheld salary of 30 days.

2. Now the petitioner has been retired from service. The petitioner is permitted to make a representation to the Secretary, Department of Man Power and Planning, New Mahanadi Bhawan, Naya Raipur, District Raipur within a period of two weeks from today and in turn, the Secretary, Department of Man Power and Planning, New Mahanadi Bhawan, Naya Raipur, District Raipur shall consider the

matter afresh considering the fact that the petitioner has already been retired from service long back and pass reasoned and speaking order within a period of three months from the date of receipt of the representation.

3. With the aforesaid observation, the writ petition finally stands disposed of. No order as to cost(s).
