1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.101/2014 {ST No.4/2015 pending in the Court of Additional Sessions Judge (FTC), Ambikapur}, registered at Police Station Chalgali, Distt. Balrampur, for the offence punishable under Sections 302, 201, 376 of the IPC and 4 of the Protection of Children from Sexual Offences Act, 2012.
2. Taking into consideration the nature and gravity of offence and facts and circumstances of the case, I am not inclined to grant bail to the applicant being the case of strangulation. However, the trial Court is directed to expedite the trial and conclude the same as early as possible particularly as five witnesses have already been examined.
