1. The claim of the petitioner is for grant of compassionate appointment. At the outset this Court finds that the writ petition is highly belated.
2. The fact of the case is that the father of the petitioner Late Easwaran Visnhu Nambudiry was an employee working in the Tribal Department, who died in harness. Subsequently, the brother of the present petitioner Vishnu Easwaran Nambudiry was given appointment on 15.07.1999 on compassionate ground. The said brother of the petitioner also died in a train accident on 28.07.2006. Subsequently, the present petitioner is alleged to have moved an application in the year 2007 for grant of compassionate appointment, which according to the petitioner till date has not been decided.
3. The contention of the counsel for the petitioner is that though he has been repeatedly approaching the department and the authorities, the authorities have been orally giving assurance, but no concrete decision has been taken by the authorities till date.
4. Given the facts and circumstances of the case at this juncture without expressing anything on the merits of the claim of the petitioner, so far as his entitlement is concerned, this Court is inclined to dispose of the writ petition with a direction to the respondents No.3 & 4 to consider and decide the application for compassionate appointment submitted by the petitioner in the year 2007 at the earliest preferably within a period of three months from the date of presentation of the certified copy of this order.
