1. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 08.11.2020 in connection with Crime No.290/2020 registered at Police Station City Kotwali, Raipur (CG) for the offence punishable under Sections 294, 323, 506-B, 327, 326 of the Indian Penal Code.
2. As per the prosecution case, a report was made by one Mallika Prajapati wife of Jai Prakash Prajapati that Jai Prakash Prajapati, who runs a hotel (tea stall) wherein the applicant came demanded money to bring liquor and having
refused, the husband of the complainant was beaten brutally to the extent that he lost one of his eye. Thereby the offence has been committed.
3. Learned counsel for the applicant submits that the case is registered for the offence punishable under Sections 294, 323, 506-B, 327, 326 of the Indian Penal Code and the applicant is in jail since 08.11.2020, therefore, the applicant may be released on bail.
4. Per contra, learned State counsel opposes the prayer for grant of bail.
5. Considering the nature of allegation and the injury caused due to which the victim has lost his left eye permanently, I am not inclined to release the applicant on bail.
