This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicants who have been arrested in connection with Crime No.17/2015, registered at Police Station-Gudhiyari, Raipur, District Raipur (CG), for the offence punishable under Sections 363, 366, 376, 342, 370(A)/34 of the IPC and Section 6 of the Protection of Children from Sexual Offences Act, 2012. 2.

Taking into consideration the facts and circumstances of the case, further taking into consideration the nature and gravity of the offence, the manner in which the minor prosecutrix aged about 12 years has been kidnapped and forcefully sexual intercourse has been committed with her and role of the present applicant, this Court is not inclined to release the applicant

on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
