The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.10/2016 registered in Police Station Lalpur, District Mungeli (C.G.) for offence punishable under sections 294, 323, 506, 307 of Indian Penal Code.

As per the prosecution case, on 10/01/2016 the applicant who was working as a Hamal under Gopal Singh landed into some altercation, at that time they were intercepted by Bhuneshwar and the applicant by way of a sickle has assaulted Bhuneshwar on abdomen, waist, thigh and near ear. Thereby, offence has been committed.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and there was no intention to kill and altercation took place between Gopal Singh and applicant and while Bhuneshwar intervened incident happened. Therefore, learned counsel submits that the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary and the statement of the victim. Also perused the medical report as many as 5 incised wounds were caused.

Taking into such nature of injury and statement, this court is not inclined to release the applicant on bail.
