1. This is the repeat bail application filed under Section 439 Cr.P.C. for grant of bail to the applicant, who has been arrested in connection with Crime No. 103/2017 registered at Police Station Bhanupratappur, District Kanker, Chhattisgarh for the offence punishable under Sections 376, 494, 419, 109, 34 of Indian Penal Code.

2. The earlier bail application stood rejected vide order dated 30.11.2017 with liberty to revive after the prosecutrix is examined. The repeat bail application has been filed after the part evidence of the prosecutrix has been recorded.

3. The prima facie perusal of the evidence till now that has been recorded so far as the prosecutrix is concerned, it is a case where she has not turned hostile rather she has supported the case of the prosecution.

4. Given the facts of the case, this Court is of the opinion that not a fit case for grant of bail to the applicant at this juncture.
