1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.10/2021 registered in Police Station Bankimongra, District Korba for offence under Section 379, 465, 467, 468, 471 read with Section 34 & 120-B of the IPC.

2. The applicant along with co-accused Anil Rathore & Vishnu Rathore hatched a conspiracy to commit theft of trailer bearing registration No.CG-04/JC-0239 and after committing theft when the trailer was parked in front of the Dhaba belonging to Sukhram Hotel, the same was taken to Raipur. For towing the stolen vehicle from the place of theft to

MCRC No. 2543 of 2021 Raipur, the accused persons prepared and concocted the registration papers in the name of present applicant and sent it to the JCB owner through Whatsapp for engaging the JCB to tow the vehicle. The trailer has been recovered from co-accused Anil Rathore.

3. Considering that the applicant is in jail since 17.1.2021 i.e. for about 51⁄2 months and the offences are triable by the Judicial Magistrate 1st Class, I am inclined to release the applicant on bail.

4. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
