The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.77/2016 registered in Police Station Sitapur Distt. Surguja for offence punishable under sections 341, 294, 506, 323, 354 A of Indian Penal Code & 8 of POCSO Act. 2012. 2.

As per the prosecution case, on 4/06/2016 while the victim was coming back from the bus stand, at that time the applicant along with other co-accused intercepted the victim and this applicant Rustom Paikara caught hold of the hand of the victim and another accused Amit had given slap to the victim. Thereby, offence is committed. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, statement of the victim is recorded, the applicant is in jail since 30/06/2016 and charge sheet has been filed, no further investigation is necessary, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of the victim. Considering the facts and circumstances of the case, degree of allegation, charge sheet has been

filed and the applicant is in jail since 30/06/2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
