1. Learned Counsel for the State submits that in this case initially offence under Sections 294 & 506 of the IPC and Section 3 (1)(10) of the SC ST (Prevention of Atrocities) Act, 1989 has been registered but, the complainant is unable to submit her caste certificate, therefore, Police has omitted with relates to Section (1)(10) of the SC ST (Prevention of Atrocities) Act and at present investigation is going on only for the offence punishable under Sections 294 & 506 of the IPC.

2. Learned Counsel for the Applicant submits that since offence under Sections 294 & 506 of the IPC are bailable in nature, therefore, he does not want to press the instant application. However, he seeks liberty may be granted to him to revive the same if any occasion will arise.

3. In view of the above submission, the instant application is dismissed as withdrawn with the aforesaid liberty Sd/- (Arvind Singh Chandel) Judge Shubham
