Learned Senior Counsel appearing for the petitioner would submit that the petitioner has worked on the post of Head Master w.e.f. 31.3.1981, therefore, pay fixation on the post of Head Master ought to have been made w.e.f. 31.3.1981.

On the other hand, learned State Counsel would oppose the writ petition and submit that the petitioner has been granted promotion to the post of Head Master on 5.2.1988 to which he joined on 12.2.1988 and benefit of 22D of F.R. was also granted to him. After successfully completion of 12 years of service, he was granted higher pay scale of Rs.1640-2900 vide order dated 15.2.1991 and the said benefit have been effective from 1.1.1986 and benefit of Rs.50/- per month of the Head Master was also granted to him w.e.f. 1.7.1975 to 31.3.1981.

I have heard learned counsel appearing for the parties and perused the documents appended wit the writ petition. 4.

The petitioner's substantive post is Upper Division Teacher and since he was holding the job of Head Master, he has been given benefit of Rs.50/- per month from 1.7.1975 to 31.3.1981 and has been promoted on the post of Head Master on 5.2.1988 to which he joined on 12.2.1988 and after completion of 12 years of service, he has been granted benefit of higher pay scale.

In view of that, the petitioner is not entitled for further relief. Upon promotion on the post of Head Master, he has been granted benefit of higher pay scale after completion of 12 years of service. 6.

Accordingly, the writ petition deserves to be and is hereby dismissed. No order as to cost(s).
