The applicant is apprehending his arrest in connection with Crime No.202/2015 registered at police station -Pamgarh, District- Janjgir Champa (CG) for alleged commission of offence under Section 186, 353, 294 of IPC. 2.
Case of the prosecution is that during petrolling when the police officer caught hold of the applicant apprehending that the applicant was involved in illegal vending of liquor, the applicant abused, threatened and also assaulted police official. 3.
Learned counsel for the applicant submits that he has been falsely implicated. As a matter of fact, the police officer had come to him to extort money in relation to which the applicant also lodged report on the same day but the police refused to take report whereafter, he submitted written complaint before the Superintendent of Police. 4.
On the other hand, learned counsel for the State opposes prayer and submits that not
only the official who has been assaulted but other police officers have also stated regarding criminal overt act of the applicant and the applicant is a person of criminal antecedent and there are as many as 7 criminal cases registered against him. 5.
Taking into consideration the submission of learned counsel for the parties and the allegation of applicant assaulting police official, the application is rejected. Sd/- Manindra Mohan Shrivastava J U D G E Rekha
