(2) This is the second bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicants, who have been arrested in connection with Crime No.74/2016 registered at Police Station Gharghoda, District Raigarh, for the offence punishable under Sections 34(1)(2) & 59(A) of the Chhattisgarh Excise Act.

(3) The applicants' first bail application was dismissed on merits by order of this Court dated 25.04.2016 passed in M.Cr.C. No.2140/2016.

(4) After hearing learned counsel appearing for the parties, I do not find any new good ground or any change in the circumstances to entertain this second bail application. Consequently, the second bail application is rejected. However, the trial Court is directed to expedite the trial and conclude the same as early as possible.

(5) Superintendent of Police, Raigarh is directed to ensure the presence of Shri Chandra Mohan Singh, IPS Officer, Gharghoda, District Raigarh on the fixed date given by the trial Court for his examination and if his presence is not secure, the trial Court is at liberty to ensure his presence by taking coercive steps at the earliest.
