Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 06/08/2021 Heard.

1. Earlier bail application was rejected on merits. Repeated application for grant of bail has been filed on the ground that subsequently the witnesses have been examined and they have not supported the seizure made by the police officer, therefore, at this stage, the applicant may be granted bail because he has remained in jail since 16.07.2020 but trial has not been concluded.

2. On the other hand, learned State counsel opposes the prayer and submits that many other material witnesses including the Investigating Officer are yet to be examined.

3. Considering the submission of learned counsel for the parties and further taking into consideration that earlier bail application was rejected by this Court on 22.01.2021, at this stage, present is not a fit case for grant of bail to the applicant. Therefore, the bail application is rejected. The applicant would be at liberty to revive the application after four months in case trial is not concluded/Investigating Officer examined whichever is earlier.
