The transfer order is under challenge on the allegation that the petitioner is being transferred to a place where earlier one Shri Santosh Kumar Pandey was posted but when he did not join, the order of transfer was modified and now the petitioner has been transferred to Patwari Halka No. 01 Korbi. 2.
It is found that the petitioner has remained posted at this place since last two years. Moreover, petitioner is transferred after completion of normal tenure within the same Tahsil. Therefore, taking into consideration the aforesaid
circumstances, I am not inclined to invoke discretionary jurisdiction to interfere with the transfer order of the petitioner. Accordingly, the petition is dismissed. Sd/- (Manindra Mohan Shrivastava) Judge Tiwari
