1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.171/2015, registered at Police Station Kharora, Distt. Raipur, for the offence punishable under Sections 363, 366, 376 of the IPC and 4 of the Protection of Children from Sexual Offences Act, 2012.

2. Taking into consideration the nature and gravity of offense and the manner in which the applicant is alleged to have kidnapped the minor prosecutrix and committed sexual intercourse with her on 26-6-2015, the date on which the prosecutrix was minor only 16 years 9 months, I am not inclined to grant bail to the applicant.
