By the impugned order dated 7.3.2019, petitioner's application under Section 79(A) of the Information Technology Act, 2000 read with Section 45 of the Evidence Act for opinion of expert of C.D. has been rejected by the Family Court, Bemetara, against which instant writ petition has been preferred.

I have heard learned counsel appearing for the petitioner and perused the impugned order with utmost circumspection.

Since both the parties have closed their evidence and the arguments has already been heard, I am not inclined to entertain this writ petition under Article 227 of the Constitution of India, and therefore, the writ petition deserves to be dismissed. 4.

Accordingly, the writ petition, being devoid of merit, is liable to be and is hereby dismissed. However, the petitioner is at liberty to raise the point in appeal, if he is required to prefer appeal. Certified copy, as per rules.
