1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.105/2017 registered in Police Station: Moudhapara District Raipur for offence under Section 420, 468, 471, 34, 409, 467 & 120-B of the IPC and Section 4, 5 & 6 of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978.

2. The applicant is the Managing Director of the G.N. Gold group of companies for Chhattisgarh area and on his inducement, Santosh Nishad became agent of the company and through him a sum of Rs.24,61,922/- was invested in various schemes of the company, but later on offices of the company were closed and all the Directors and

MCRC No. 2807 of 2021 responsible officers/persons went in hiding.

3. Learned State Counsel submits that all over Chhattisgarh 3,379 persons have invested to the tune of Rs.4,78,22,679/- approximately and thus the depositors have been cheated of this amount.

4. Admittedly, co-accused has been released on bail in MCRC No.2180/2018. Various crimes have been registered against this applicant on the FIR lodged by different depositors and in some of them bearing MCRC Nos.7518/2020, 152, 171, 290, 299, 310 of 2020, as also in MCRC No.2570/2021, 7303/2020 and 7075/2020, the applicants have been released on bail.

5. Considering that the present applicant is in jail since 28.11.2017, i.e. for about 31⁄2 years, and in similar crime number, he has already been released on bail, I am inclined to release him on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one local surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
