With the consent of the learned counsel for the parties, the matter is heard finally.

This writ petition has been preferred seeking quashment of the departmental enquiry proceeding, which is pending against the petitioner since January, 2003.

Learned counsel for the petitioner would submit that the enquiry officer has already submitted a report in the year 2004, yet despite lapse of about 11 years thereafter, no decision has been taken by the disciplinary authority.

Considering the entire facts situation of the case, the writ petition is disposed of with a direction that the disciplinary authority shall take final decision in the matter, if already not taken, at the earliest, preferably within a period of 4 months from the date of submission of certified copy of this order.

It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the matter, on its own merits, strictly in accordance with law, without treating any observation made in this order, as opinion on the merits of the case.
