1. Heard.

2. Learned counsel for the petitioner would submit that the services of the petitioner were sent on deputation by the order of the Government dated 15-10-2009, but the impugned order repatriating his services have been passed by the Chief Executive Officer of the Zila Panchayat, Bilaspur and as such, the Chief Executive Officer has no jurisdiction and authority to pass the impugned order.

3. Learned State counsel would submit that the State be granted liberty to pass fresh order in accordance with law.

4. The prayer is fair and reasonable.

5. The petition is disposed of with liberty to the State to pass fresh order in accordance with law preferably within a period of one week from today. No order as to costs.
