1. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.01/2021 registered in Police Station Maudahapara District Raipur C.G. for the offence punishable under Section 20(b) of the N.D.P.S. Act.

2. As per the prosecution case, applicant was allegedly found in illicit possession of 9 Kg & 650 gram of ganja and 350 gram of charas, when his house was searched on 01.1.2021.

3. Learned State counsel would submit that applicant has previous antecedent of his involvement in other crimes but none of them includes offence under NDPS Act.

4. Considering the fact that applicant is in jail since 01.1.2021 i.e., for 6 1⁄2 months as also for the fact that charge sheet has already been filed, I am inclined to release the applicant on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
