This is second bail application under Section 439 of CrPC.

The earlier bail application was dismissed on merits on 06/02/2014.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 334/2013 registered in Police Station Lal Bag, Rajnandgaon, District Rajnandgaon (C.G.) for offence punishable under Section 4,6,7,9,10 & 11 of Chhattisgarh Agriculture Cattle Preservation Act, 2004, Amended Act 2011 section 4,5 & 6 of the Animal Cruelty Act 1960 section 11 and Cattle Transportation Rule 1978 Section 47(A), (B), (C), 48, 49(A)(B)(C), 50, 52, 53 and under Section 66/192 of the Motor Vehicle Act. Learned counsel for the applicant submits that the similarly placed accused namely Ramesh Khandekar @ Tayyab has been released on bail in M.Cr.C. No.5583/2014 on 15/10/2014, therefore he prays for release of the applicant on bail.

Learned State counsel however do not oppose the fact that co-accused has been enlarged on bail on similar ground.

Having regard to the fact that applicant is in jail since 30/09/2013 and similarly placed co-accused namely Ramesh Khandekar @ Tayyab has been released on bail in M.Cr.C. No.5583/2014 on 15/10/2014, I am inclined to release the applicant on bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court. Certified copy as per rules.
