-1- NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WRIT PETITION (S) NO. 4963 OF 2016 • Ram Gopal Verma, aged about 61 years, S/o Deena Ram Verma, presently working as Revenue Inspector, posted at Revenue Circle, Simga, District Balodabazar-Bhatapara (C.G.) ... Petitioner
Versus
1.
State of Chhattisgarh, through the Secretary, Department of Revenue & Disaster Management, Mantralaya, Mahanadi Bhawan, New Raipur, District Raipur (C.G.) 2.
Collector, District Balodabazar-Bhatapara (C.G.) 3.
Additional Collector, District Balodabazar-Bhatapara (C.G.) ... Respondents For Petitioner :
Mr. Manish Thakur, Advocate.
For Respondents :
Mr. Syed Majid Ali, Panel Lawyer.
Hon'ble Shri Justice P. Sam Koshy Order on Board 23/03/2017 1.
Challenge in the present writ petition is to the order dated 5.8.2016 (Annexure P-1) whereby the Petitioner, whose name reflects at Sl. No.1, has been ordered to be transferred from Revenue Circle, Simga to Revenue Circle, Kasdol.
2.
The sole ground of challenge is that, since the Petitioner was posted at Simga and he is to retire on 30.4.2017 at the fag-end of his service, he could not be transferred.
3.
This Court while entertaining the present writ petition, on 21.9.2016, had granted an interim protection to the Petitioner, by virtue of which the Petitioner is still working at Revenue Circle, Simga.
4.
Be that as it may, considering the fact that the Petitioner is going to retire in a short span of about 11⁄2 months time, the present writ petition is disposed of, with a direction that the Respondents shall not act upon the order of transfer so far as the Petitioner is concerned and shall permit the Petitioner to
-2retire on the present place of posting, i.e., Simga, treating the impugned order (Annexure P-1) to have been cancelled so far as the Petitioner is concerned. 5.
With the aforesaid direction, the present writ petition stands allowed and disposed of. No order as to costs.
