1. Heard on IA No.1, an application for condonation of delay of 88 days in filing the CRMP.

2. On due consideration, the application is allowed and the delay is condoned.

3. Also heard on admission.

4. The trial Court has acquitted the accused of the charges under

CRMP No. 696 of 2019 Sections 376 and 506(Part II) of IPC.

5. The prosecutrix examined as PW-9 has not supported the case of the prosecution at any stage of her examination. Five witnesses namely Sugantin, Surit Yadav, Babulal, Biso and Dodhan were named in the FIR as the persons to whom the prosecutrix informed about the incident. However, even these witnesses have turned hostile and have not supported the case of the prosecution.

6. No case for grant of leave to appeal is made out.

7. The CRMP is dismissed.
