Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 23/09/2016 The petitioner has challenged order dated 25/07/2016 on the apprehension that by impugned order, the petitioner is being transferred to hospital at Balrampur by treating him as contract employee whereas the petitioner is a regular Government Servant and had undertaken P.G. course as in-service candidate. 2.
Learned State counsel, referring to recitals of impugned order, submits that petitioner's apprehension is not well founded. It is submitted that earlier order dated 25/05/2016 has been amended only to clarify that the petitioner has not been posted as contract employee.

Obviously, the petitioner being a regular employee in the health services of the Government, cannot be treated as a contract employee while transferring him from one place to other place. Accordingly, it is directed that order dated 25/07/2016 shall not be used against the petitioner to hold him as a contract employee in any
manner. His status as regular Government Servant shall remain unaffected by the impugned order.
