The grievance of the petitioner is the inaction on the part of the respondents in not considering and deciding the claim of the petitioner for dependent employment.

2. According to the petitioner, her father late Arun Kumar Pandey was working under the respondents and he died in harness on 16.08.2018. According to the petitioner, the petitioner though married were totally dependent upon the income of the deceased employee and were staying along with the deceased at the time of his death, therefore the petitioner has moved an application for grant of dependent employment, however her application till date is not finalized.

Learned counsel for the petitioner submits that as regards the claim of the married daughter, whether she is entitled for dependent employment under the respondents, the said issue already stands decided by a couple of decisions of this High Court and also by the Division Bench of this Court. The leading case of which being the case of "Smt. Asha Pandey v. Coal India Limited" WPS No. 4994/2015, the decision of which was confirmed up till the stage of Hon'ble Supreme Court.

Learned counsel for the respondents submits that since her application has till date not been finalized, the authority shall consider the claim of the petitioner after due verification of the facts in accordance with law as it stands today.

Given the said submissions, the writ petition at this juncture stands disposed of directing the respondents No. 2 & 3 to take an appropriate decision on the claim of the petitioner in accordance with law at the earliest preferably within a period of 90 days from the date of receipt of the copy of this order.

With the aforesaid observations, the present writ petition stands disposed of.
