This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.280/2015, registered at Police StationMahasamund, District Mahasamund (C.G.), for the offence punishable under Section 376 of the IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012, 2.

I have heard learned counsel appearing for the parties and taking into consideration the facts & circumstances, further taking into consideration the nature & gravity of the offence and the manner in which the applicant is said to have committed sexual intercourse with minor and mentally retarded prosecutrix aged about 14 years supported by medical evidence, I am of the view that present is not a fit case for grant of bail to the applicant.
