Taking into consideration the evidence of PW-1 Panchram Sahu and the other witnesses this Court is of the opinion that an arguable case has been made out by the State counsel for reconsidering the order of acquittal dated 08.07.2016 passed by the Special Judge (Prevention of Corruption Act), Bemetara. in Special Case No. 01/2015.

Accordingly, the present application is allowed. Leave as prayed for is granted. Office is directed to register the case as a regular Acquittal Appeal. Heard the Acquittal Appeal on admission.

Admit.

Issue notice to the respondent on payment of process fee within seven days from today by both the modes.

List this case for final hearing in due course. Meanwhile, the records of the Court below may also be called for.
