This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 259/2015, registered at Police Station Kotwali, Distric Bastar (C.G.), for the offence punishable under Sections 394 & 34 of I.P.C.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; the manner in which applicant and other two co-accused persons are said to have looted two mobile phones and Rs.13,400/- held by complainant Bhim Kumar Sahu on 06/07/2015 and the consequent recovery from the possession of present applicant, this Court is not inclined to release the applicant on regular bail. 3.
Accordingly, bail application filed under Section 439 of the Cr.P.C. is
rejected.
