This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 22/2014 registered at Police Station Bankimongara, District Korba (C.G.), for the offence punishable under Sections 363, 366/34, 392, 394 of I.P.C.

Applicant was enlarged on bail but he jumped bail on 08/08/2014, thereafter, he was arrested on 18/08/2014.

Learned counsel for the applicant would submit that nonappearance of the applicant on 08/08/2014 was unintentional as he is resident of Orissa and could not reach to the trial Court on 08/08/2014, therefore, he may be released on bail.

The reasons assigned by the learned counsel for the applicant

being acceptable.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed.

It is directed that applicant shall be released on bail on furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court, for his appearance as and when directed. 7.
