1. Heard.
2. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.466/2019 registered in Police Station Thana-Palari, distt. Balodabazar- Bhatapara C.G. for the offence punishable under Section 304(B)/34 of the I.P.C.
3. Case of the prosecution, in brief, is that the applicant was married with deceased Smt. Kiran Bai about four years ago. She
MCRC No. 3293 of 2020 committed suicide by consuming poison on 24.11.2019. There is an allegation of demand of dowry, however, such demand was not made directly to the parents or any other relative of the deceased. Except for this general allegation of demand of motor cycle there is no allegation of physical cruelty.
4. This Court has already allowed anticipatory bail to Madan @ Madan Lal Manhare in MCRCA No.130/2020, Uttra in MCRCA No.177/2020 and Digeshwari Dhritlahre in MCRCA No. 186/2020. The present applicant is in jail since 17.12.2019 i.e., for more than 09 months and charge sheet has already been filed.
5. Considering all relevant aspects of the matter; particularly the length of pre-trial detention and the general allegation of demand of motor cycle, this Court is inclined to release the applicant on bail.
6. Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of ₹50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
