(2) Learned counsel for the petitioner would submit that the petitioner, who is working as Assistant Grade-II, has been transferred vide order dated 20.07.2015 passed by the Collector, Bilaspur, in the

same capacity from the Establishment of Tehsil OfÏce, Bilaspur to Tehsil OfÏce, Masturi. He would further submit that respondent No.6 Santosh Kumar Soni is joining at the petitioner's place on his own request, therefore, it is apparent that the petitioner is transferred to Masturi in order to accommodate respondent No.6 and moreover, one more Assistant Grade-II Om Prakash Pandey, who is working at Bilaspur for last 12 years, has not been transferred.

(3) Having considered the entire facts' situation of the case, it is directed that the petitioner shall submit a fresh representation before the Commissioner, Bilaspur within a period of 15 days from today in accordance with para 4 of the transfer policy and thereafter, the said authority shall consider and decide the petitioner's representation, at the earliest, preferably within a period of 3 months from the date of submission of representation.

(4) Till the petitioner's representation is decided, the effect and operation of the impugned order shall remain stayed. Sd/- Judge (Prashant Kumar Mishra) Shyna
