1. Learned counsel for the petitioner submits that the legal position that upon reinstatement from suspension, the employee is liable to be posted at the same place wherefrom he was suspended, has been well settled by this Court vide order dated 8.9.2015 passed in the case of Khadanand
-2Patanwar Vs. State of Chhattisgarh & Ors. (WPS No.3146 of 2015).
2. Learned counsel for the State submits that though the legal position is settled by this Court, the matter requires consideration by the authority who reinstated the petitioner.
3. Considering the submissions made, in the opinion of this Court, this petition at this stage, can be disposed off with a direction to respondents No.1 & 2 to examine the case of the petitioner and pass appropriate order of posting as per the law laid down by this Court in the case of Khadanand Patanwar (supra).
