1. Heard.

2. The applicant has preferred the first bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.10/2021, registered at Police Station Basna, District- Mahasamund (C.G.) for the offence punishable under Sections 457, 380, 34 of the Indian Penal Code.

3. The applicant has committed theft of Stitching machine, Piku machine, Gas cylinder, one Air conditioner, Silver coin, Golden mangalsutra and Rs.8,000/- total amounting to Rs.72,000/- from the house of the complainant.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering that the applicant is in jail since 06-01-2021 and the charge sheet has already been filed and also for the reason that the offences are triable by the Judicial Magistrate First Class, I am inclined to release the applicant on bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
