1. Perusal of the order-sheet shows that the appellant is in jail since 03.09.2006 and the order of the trial Court also shows that the appellant was not enlarged on bail. The substantive jail sentence was for 7 years under Section 307 IPC with fine of Rs.200/- with a usual default stipulation.

2. Facts of the case shows that the appellant has already suffered the jail sentence imposed upon him.

3. Counsel for the appellant do not want to press this appeal on merits. Consequently, the appeal is dismissed.
