Advocate General Hon'ble Shri Justice Pritinker Diwaker Order On Board 21/05/201 The applicant has field this application under Section 439 of the Code of Criminal Procedure for grant of regular bail as he is in custody in connection with Crime No. 185/2017 registered at Police Station Arang, Raipur (CG) for the offence punishable under Sections 420, 467, 468, 471, 34 of IPC.

As per the prosecution case, on the basis of forged documents the applicant has obtained loan of Rs.90,000/- from Dena Bank, Samuda Branch, Raipur.

Counsel for the applicant submits that co-accused had taken his photographs and misused the same. He submits that the applicant is in jail since 06.10.2017 and that the offences are triable by the Magistrate. 4.
On the other hand, counsel for the State opposes the bail application.

Considering the totality of the facts and circumstances of the case, this Court is of the opinion that it is a fit case to release the applicant on bail.

Accordingly, the application for grant of bail is allowed and the accused/applicant is directed to be released on bail on his furnishing a personal bond of Rs.2,00,000/- with one surety for the like sum to the satisfaction of the concerned Magistrate for his appearance before it as and when directed.
