1. This is third bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 367/2015 registered at Police Station Civil Line, Distt. Bilaspur (C.G) for the offences punishable under Sections 20-B of the Narcotic Drugs and Psychotropic Substances Act.

2. The applicant was enlarged on bail on 27.6.2016, thereafter he jumped the bail on 27.4.2017 and was arrested on 11.08.2017 and since then he is in jail.

3. Learned counsel for the applicant submits that the applicant was earlier enlarged on bail, however, because of genuine reasons, he could not appear on one day and the bail was cancelled.

4. Per contra, learned State Counsel opposes the bail application. .

5. Considering the period of detention of the appellant as he is

stated to be again lodged in jail since 11.8.2017 for default of appearance and the fact that earlier, the applicant was enlarged on bail on 27.06.2016, I am inclined to release the applicant on bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court for his appearance before the said Court as and when directed.
