1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.469/2019 registered in Police Station: Surajpur, District Surajpur for offence under Section 302, 201 & 120-B/34 of the IPC.
2. Deceased Tanvir Ahmad was the husband of co-accused Afsana. Another co-accused Mahfuj Alam had an affair with Afsana, therefore, in order to eliminate the deceased Tanvir Ahmad, the accused persons hatched a conspiracy and in execution thereof, the deceased was murdered on 2.12.2019 and the evidence of crime was concealed by putting the dead body in the steering seat of the tempo and the same
MCRC No. 2586 of 2021 was turned turtle to give it a shape of accident.
3. Admittedly, the bail application of co-accused Mahfuj Aalam against whom there are similar evidence has been dismissed by this Court in MCRC No.6310/2020.
4. Considering the entire fact situation of the case and dismissal of bail application of the co-accused, I am not inclined to release the applicant on bail. Accordingly, the application is rejected. Sd/- (Prashant Kumar Mishra) Acting Chief Justice Barve
