This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.44/2015, registered at Police Station Mandir Hasoud, District Raipur (C.G.), for the offence punishable under Sections 363, 366, 376 of Indian Penal Code & Section 3, 4 of Protection of Children from Sexual Offence Act, 2012. 2.
After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; nature and gravity of offence and age of the prosecutrix, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected. However, since four witnesses have already been examined, the
trial Court concerned is directed to expedite the trial and decide the case as early as possible preferably within a period of three months. 4.
