1. By the impugned order, the non-applicant's (the petitioner herein) opportunity to lead evidence has been closed against which this writ petition has been preferred.

2. Learned counsel for the petitioner submits that the order impugned is unsustainable and bad in law.

3. Learned counsel for respondent No.2 opposes the petition and supports the impugned order.

4. Since the evidence of the present petitioner is necessary to be

brought on record in order to decide the claim petition effectively, subject to payment of cost of ₹ 5,000/- to the applicant (respondent No.1 herein) - Kumari Salma Begum, the petitioner is granted opportunity to lead its evidence before the Claims Tribunal. Cost will be paid before the Claims Tribunal.

5. The writ petition is disposed of with the aforesaid direction. No order as to cost(s).
